Alfano law violates Article 3 and Article 138 of the Constitution of the Italian Republic
In the frenzy of insults and rants broken, that followed the declaration of unconstitutionality of the law Alfano, the retinue of servants and various courtiers, could not argue much to protest against the sentence. The speed at which they appealed (with a little imagination) is the official reason for Napolitano in a hurry to promulgate the law, the previous Constitutional Court ruling on the law Schifani did not indicate the anomaly of a constitutional immunity enacted by ordinary law. The rest was from that day did you post on this topic, the columns of Corsera the usual television lounges.
As always we talk or read without forgetting some point. The Constitutional Court ruling on the law Schifani reads:
" [...] the first national court sees a violation of the principle of equality in Article 3 of the Constitution and Article 112 of the Constitution .
Nor should we fail to consider that the principle of equality is one of the founding principles of the Constitution, only be derogated by the Constitution or constitutional amendments adopted pursuant to art. 138 of the Constitution, as is confirmed by the fact that all charges relating to the powers or functions are regulated by the constitutional sources of that rank "
That is, the Court was fully consistent in both judgments ... if anything was wrong Napolitano that enacted the law by using unfounded reasons. Sure sorry that spouts insults and gratuitous insults ... but if you start doing the guarantor of the mafia, then do not be surprised if they take these with you when you do not collect the contract sum.
ps. And if you happen to be around, even someone who says, "in other countries, there is an immunity ... blah, blah, blah "Explain that the only forms are those provided for immunity for acts related to the performance of official acts and functions (government, parliament, etc). In no country, immunity for acts that occurred before or after the term of office, nor for events that occurred during (if the allegations are not related to the role of government) .
Even the parliamentary immunity that existed in Italy before the '92 would not have saved him from his unbalanced processes.
